These terms apply to your use of iSMS, a service for sending SMS messages. By creating an account you accept them. The service is run by KyrosNext LLC ("we", "us").
1. Your account
- You must give true details and keep them up to date.
- Keep your password and API keys secret. What happens under your account is your responsibility.
- To create an API key you must first sign in to your account. If you use the API, it is your responsibility to check these terms from time to time and to accept them when they change.
- We may ask you to confirm your email address and mobile number.
- An administrator may need to approve a new account before it can send.
2. Credits and payment
- You send messages with credits that you buy in advance. The price of an SMS depends on the destination country and your plan, and is shown in your account before you send.
- A message is charged when it is queued. Credits that are used, and credits that have expired, are not refunded.
- Prices may change. A change does not affect messages already sent.
3. What you may send
- You may send only messages to people who agreed to receive them, or whom the law allows you to contact.
- You must not send spam, unlawful, misleading, threatening, hateful or adult content, or anything that breaks the rules of mobile operators.
- Messages that promote or sell must make it easy to opt out. You must respect opt-outs and the blacklist in your account.
- You are the one who decides what is sent and to whom. You are responsible for it, including the consent of your recipients.
4. Sender names
- A sender name must be one you are allowed to use. We may refuse, change or remove a name, especially names of banks, public services or other companies.
- Pretending to be someone else is forbidden.
5. Delivery
- We pass your messages to mobile operators and partners. We cannot promise that a message arrives, or when. Operators, phones and networks outside our control can delay or stop it.
- Delivery reports are given as received from the operators. A message without a report after a time is shown as unknown.
6. Suspension and closing
- We may refuse or stop messages, suspend or close an account that breaks these terms or the law, or that puts the service or other customers at risk.
- You may stop using the service at any time. Unused credits are refunded only where the law requires it.
7. Our responsibility
- We provide the service with reasonable care. We do not promise that it will be uninterrupted or free of errors.
- As far as the law allows, we are not responsible for indirect loss, lost profit or lost business, and our total responsibility for a claim is limited to the amount you paid us in the three months before it.
- Nothing here limits a responsibility that the law does not allow us to limit.
8. Your data
We handle personal data as described in the Privacy policy. For the contact details of your own recipients, you decide the purpose and we process them for you.
9. Changes
We may change these terms. We will tell you in the service or by email. If you keep using the service after a change, you accept it.
10. Law and courts
These terms follow the laws of Greece and the courts of Athens. Rights that the law gives you as a consumer are not affected.
